I. General Terms and Conditions
§ 1 Basic Provisions
(1) The following terms and conditions apply to contracts that you conclude with us as the provider (Miss Marble Nails UG) via the website marble.school. Unless otherwise agreed, the inclusion of any of your own terms is hereby rejected.
(2) A consumer in the sense of these terms is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed professional activities. An entrepreneur is any natural or legal person or a legal partnership who, when entering into a legal transaction, acts in the exercise of their independent professional or commercial activity.
§ 2 Conclusion of the Contract
(1) The subject of the contract is the sale of goods.
(2) By listing a product on our website, we make a binding offer to conclude a contract under the conditions specified in the product description.
(3) The contract is concluded via the Elopage purchasing system as follows:
The goods intended for purchase are forwarded to the payment process via the "Buy" button using the Elopage platform. The payment process is integrated into the marble.school website.
After entering personal data, as well as payment and shipping information, all order details are displayed on the order summary page.
If you use an instant payment system (e.g., PayPal / PayPal Express, Amazon Payments, Sofort), you will either be redirected to the order summary page in our online shop or to the website of the selected instant payment provider.
If redirected to an instant payment system, you complete your payment details on the provider's website. You will then be returned to our online shop’s order summary page.
Before submitting the order, you can review and modify all data (using the "back" function of your browser) or cancel the purchase.
By clicking the "Buy" button, you legally accept our offer, and the contract is concluded.
(4) The processing of the order and the transmission of all contract-related information take place via email, some of which is automated. You must ensure that the email address you provide is correct, that email receipt is technically ensured, and that our emails are not blocked by SPAM filters.
§ 3 Special Agreements on Payment Methods
(1) Invoice Payment via Klarna Germany
We offer invoice payment via Klarna. The payment period is 14 days from the invoice date. The invoice is issued upon shipping and is either sent via email or included with the shipment. The payment must be made to Klarna. Please note that Klarna invoice payment is available only to consumers. The full terms and conditions for Klarna invoice purchases can be found here.
Privacy Notice
Klarna verifies and assesses your provided data and, if there is a legitimate interest, exchanges data with other companies and credit agencies. Your personal data will be processed in accordance with applicable data protection laws and Klarna's privacy policy.
§ 4 Right of Retention, Retention of Title
(1) You may only exercise a right of retention if it pertains to claims arising from the same contractual relationship.
(2) The goods remain our property until full payment of the purchase price.
§ 5 Choice of Law, Place of Performance, Jurisdiction
(1) German law applies. For consumers, this choice of law only applies insofar as it does not deprive them of the protection granted by mandatory provisions of the law of their habitual residence (favorability principle).
(2) The place of performance for all obligations and the place of jurisdiction is our registered office, unless you are a consumer. If you are a business entity, legal entity under public law, or a special fund under public law, the same applies. This also applies if you have no general place of jurisdiction in Germany or the EU or if your residence or habitual residence is unknown at the time of filing a lawsuit. The right to appeal to a court at another statutory place of jurisdiction remains unaffected.
(3) The provisions of the UN Convention on Contracts for the International Sale of Goods (CISG) do not apply.

2. Information on Contract Conclusion
The technical steps involved in contract conclusion, the contract itself, and correction options are outlined in the section "Conclusion of the Contract" in our General Terms and Conditions (Part I).
3. Contract Language, Storage of Contract Text
3.1. The contract language is German.
3.2. We do not store the full contract text. Before submitting your order via the online shopping cart, you can print or electronically save the contract details using your browser’s print function. Once we receive your order, the order details, legally required distance selling information, and our General Terms and Conditions will be emailed to you.

The essential characteristics of the goods and/or services are found in the respective product description.
5. Prices and Payment Methods
5.1. The prices listed in each offer, as well as shipping costs, represent total prices including all taxes.
5.2. Shipping costs are not included in the purchase price unless free shipping is explicitly offered. They can be viewed on our website or within the respective offer.
5.3. If you are ordering from within the EU, but paying from outside the EU, you are responsible for any associated money transfer fees (e.g., bank transfer or exchange rate fees).
5.4. The available payment methods are indicated on our website or in the respective offer.
5.5. Unless otherwise stated, all payments are due immediately upon contract conclusion.
6. Delivery Conditions
6.1. Delivery conditions, delivery times, and any restrictions are specified on our website or within the respective product offer.
6.2. If you are a consumer, the risk of accidental loss or damage during shipping transfers to you only upon delivery, regardless of whether the shipment is insured or not. This does not apply if you have independently hired a transport company.
If you are a business entity, the risk transfers to you once the goods leave our warehouse.
7. Statutory Warranty Rights
Warranty obligations comply with the regulations set forth in the "Warranty" section of our General Terms and Conditions (Part I).
